Danny Cipriani smoked a suspicious looking cigarette on the street in Los Angeles this week.
The former professional rugby union player, 36, was seen in just a pair of black trousers and puffing away in a part of North Hollywood.
The star has spoken openly of his previous drug and alcohol abuse, but just eight months ago told The Sun on Sunday he was 'free' from substances.
Last year Danny revealed he ended up in The Priory after he cracked his own skull due to overdosing on magic mushrooms.
He is thought to have bought the cigarette from a shop called Project Cannabis, near where he is staying. Recreational use of cannabis in California is legal.

Danny - who is in the US spending time with his new actress girlfriend AnnaLynne McCord - was seen smoking the cigarette early in the morning before getting dressed into a purple and black checked shirt and smoking some more.
The remains of the pre-rolled cigarette - which came in a green tube labelled Green Crack and retails at $5 - were then discarded on the floor.
It comes after reports that Danny has signed up for Bear Grylls' new Netflix reality show Bear Hunt.

He recalled: 'I'm standing at the top of some stone stairs in the garden, thinking, "The only way to escape this terrible experience is to let go". So, I put my arms out, lean back, topple over and smash my head on the edge of a step.
'Victoria hears my skull crack and reckons she can hear gas coming out. She's crying hysterically because she thinks I'm dead.'
He said that she called an ambulance to rush him to the hospital but he remained convinced there was a 'big conspiracy' to hurt him, involving his wife and all the nurses.
Danny said: 'I'm losing a lot of blood but I won't let any of them touch me. I still think Victoria is trying to kill me, but she's the only person I want close.'
He explained that after his discharge, Victoria put him into the Priory for a week, where he lost lots of weight after barely eating.
He added: 'When I go for a walk in the garden, the flowers and the birds don't seem real. When I finally come out of this trip I realise that fear was driving it. The fear of not being loved, the fear of not being enough. That told me there was still plenty of buried trauma that needed unearthing and sifting through.'
Last week Danny proudly flaunted his romance with new girlfriend AnnaLynne days after his estranged wife Victoria took a swipe at him.
He recently revealed he was in a relationship with AnnaLynne, 36, and last week he looked well and truly smitten as he packed on the PDA with the American actress on a lunch date in Los Angeles.
