Erika Jayne's money troubles and legal woes are showing no signs of wavering, as it's been revealed she is now struggling to pay off a huge tax bill - despite recently refusing to 'downsize' on her rumored $40K-a-month glam squad. 

The Real Housewives of Beverly Hills star - who has been caught up in estranged husband Tom Girardi's 2020 bankruptcy case - has claimed that she is unable to pay $2,226,985.77 in California state taxes from 2019. 

It comes after the 50-year-old said on a recent episode of RHOBH: 'You can downsize and we've downsized, right? Certain things you don't downsize on and that's your glam.'

But in legal documents obtained by PEOPLE, it is stated that Erika claims she does not have the 'ability' to pay the California tax board, after receiving a notice from administers in May this year. 

The filing reads: 'I am in the midst of trying to figure out the basis of this tax bill with the assistance of my business manager, who is also an accountant. I do not have the ability to pay the [California Franchise Tax Board] tax bill.'

Erika states in the docs that she is unsure if the tax board is 'claiming any sort of lien' in regards to her $750,000 pair of earrings which she has been asked to return due to Tom's bankruptcy case. 

It had been previously alleged in court filings that the earrings were bought via at client trust at Tom's law firm Girardi Keese and written off as part of tax expenses. Erika was ordered to return the items to help pay off Tom's creditors.

'I never worked at the law firm of GK,' Erika stated in her filing. 'I never managed the finances of GK. I never had access to or knew anything about how TG or GK managed any of their client trust accounts.'

'At the time, based on everything I knew, TG and our marital community had extensive net worth and TG and GK had very high income. I had no reason to doubt or question the source of funds used by TG to buy the earrings,' she added.

'I never knew or heard anything from anyone to the effect that any of the gifts that TG had given me at any time, including the earrings in 2007, were bought using money that did not belong to TG or that belonged to someone else.'
