The couple originally sought $5,392 over a claim of negligence against Assured Real Estate director Britney Kraus, after they said they'd lost money in unclaimed rent. They told the tenancy watchdog that Ms Kraus had failed to notify the couple over a lapsed landlord insurance policy, reports News.com.au. However, the Tribunal said Kraus had not breached any local consumer laws in her failure to take recovery action against a tenant on behalf of the Carrs' over unpaid rent. In a statement to NCA NewsWire, Kraus said the matter had been discussed with Ryan. 'We submitted an email [to Ryan Carr],' Kraus said, '...to the effect of, "Ryan, as discussed on the phone, you you do not wish for our agency to pay your landlord insurance policy as you are going to search for a better provider." 'We therefore did not pay his policy.' She slammed NSW Fair Trading for putting her business under strict compliance monitoring last week. Her real estate agency has been the subject of 171 complaints to Fair Trading, from tenants and landlords alike, since 2017. An investigation by NSW Fair Trading found her agency failed to lodge rental bonds, failed to complete trust account trial balances and had contravened rules of conduct - all of which she was fined for. Further complaints to Fair Trading alleged she withheld rental income from landlords, withheld supply documents and failed to pay water and strata bills among other findings.
