Simon Robert Miller, 43, a man, aged 20, and a boy, aged 17, had been 'drinking heavily' before they went into the McDonald's in Boston, Lincolnshire on August 7. The two younger males put Zac MacDonnell in a cupboard, stole his glasses and goaded him about his sexuality, Boston Magistrates Court heard. Three people have appeared in court charged with assault after a McDonald's employee was 'locked in a cupboard' and other staff were assaulted. The group left and then Miller came back in and punched Nathan Whittemore and the youth punched Mr McDonnell. The 17-year-old also assaulted Oakleigh Weekes. During the incident one of the youths took a metal strip from the door and used it to cause damage to a window and a wall, before assaulting a staff member. Following his arrest, Miller said he had only got involved to stop the other two defendants but admitted he did slap Mr Whittemore, in self defence, the Rutland & Stamford Mercury reported. The incident was described as 'shocking and terrible behaviour' by magistrates. Miller, of Sleaford Lincolnshire, admitted assault by beating Nathan Whittemore. The 20-year-old admitted assault by beating plus threatening behaviour with intent to cause people to believe immediate violence would be used against them. The 17-year-old admitted assaulting Mr Whittemore as well as Oakleigh Weekes and Mr McDonnell by beating. The boy also admitted threatening behaviour and criminal damage to an external window and an internal wall at McDonald's during the incident. Prosecuting, Ruth Snodin said the two young men attacked Mr Whittemore after he had asked them to leave the premises. She said damage was caused to the restaurant by the youth, who damaged a window and a wall. She added after the group left the restaurant, Miller returned and punched Mr Whittemore and the youth came back in and punched Mr McDonnell. Martin Newton, mitigating for the two unnamed men, said the incident was 'something out of character' for both. He said all three had been drinking and 'clearly became the worse for wear'. He said the two younger ones put each other into the cupboard before putting Mr MacDonnell inside it. He also explained 'a number of punches were thrown' and that after things had died down, the youth took a metal strip from the door and used it to cause damage to a window and a wall. Stuart Wilde, mitigating for Simon Miller said he 'had a clash with Mr Whittemore'. 'He came late to the party,' he said 'and at most one punch was thrown.' The court heard the younger two males apologies to McDonald's about their behaviour. Simon Miller was fined £378 with £122 in costs and charges. The 20-year-old was fined £416 with £126 in costs and charges and he was ordered to pay £100 compensation to Mr Whittemore. The youth's offending 'passed the custody threshold' and he will be sentenced at the Youth Court on March 12.
