Fox stands by 'consummate professional' Jussie Smollett and denies claims he is being written out of Empire Fox issued a statement in suppose of the actor on Wednesday afternoon  It came after claims his scenes were being cut amid the ongoing controversy  He is currently filming the final episodes of the show's fifth season in Chicago On Tuesday, two brothers who claim he paid them to attack him were due to testify against him before a grand jury but were halted at the last minute Hours later, the prosecutor in charge of the probe recused herself from the case No charges have been filed against the actor or the brothers involved They say Smollett was also behind a threatening letter he received January 22

20th Century Fox has denied claims Jussie Smollett is being written out of Empire.  

In a statement on Wednesday morning, a spokesman for the studio told DailyMail.com: 'Jussie Smollett continues to be a consummate professional on set and as we have previously stated, he is not being written out of the show.' 

Smollett is facing allegations he staged an attack on January 29 which he reported to police as a homophobic and racist ambush. 

Multiple police sources have repeatedly leaked details of their investigation to local outlets to suggest their belief that he made it up - a claim he denies.

Fox initially stood by the actor after the January 29 incident became public but went quiet as more details of the police investigation into it emerged. 

Their complimentary remarks on Wednesday come after a sudden and dramatic chain of events in court. 

On Tuesday, brothers Ola and Abel Osundairo - who allegedly told police last week that Smollett paid them to attack him - were minutes away from testifying before a grand jury when Smollett's legal team put in a 'hail Mary' call
