Hayne's alleged rape victim, known in court filings as JV, initially argued the 31-year-old father be questioned in California - where the alleged 2015 rape took place - ahead of their 2020 civil trial in San Jose. But court documents exclusively obtained by DailyMail.com show that JV and Hayne reached an agreement to have the Australian footballer and his two friends Bryce Poisel and Timothy Dengate - both listed as witnesses in this case - questioned in Australia. The deal notes that the three men have voluntarily made themselves available for deposition in Sydney and they 'cannot be compelled to attend a deposition in California' because they live in Australia. The 31-year-old father-of-one has denied raping the woman in 2015, but was also accused of sexual assault in fall 2018 (pictured leaving court in the latter case) The documents state that the parties have agreed that Hayne will pay the court reporting fees for Poisel and Dengate and they will be deposed in Sydney to also save money. JV will bear the court reporting fees for Hayne, according to the filing. Court filings from December initially stated: 'The parties have agreed in principle to split the reasonable costs of flying Australian foreign nationals Bryce Poisel and Tim Dengate for depositions in Los Angeles, California. 'However, in the event that the parties cannot come to an agreement on the costs, defendant intends to bring a motion for issuance of letters of request for permission to depose those witnesses in their home country of Australia.' JV claims she was a virgin and heavily intoxicated when she met Hayne at a San Jose bar with friends in 2015 while he was playing in the NFL with the San Francisco 49ers. She alleges having 'minimal interaction' with Hayne at the bar and taking an Uber with him to his apartment where he sexually assaulted her. Hayne has strongly denied her rape claim and said they 'willingly engaged in sexual interaction that did not include sexual intercourse'. San Jose police investigated her allegations and decided not to charge Hayne, but JV pushed ahead by filing a civil lawsuit in California seeking monetary damages. The legal teams have indicated they will arrange for forensic testing of certain items seized by the San Jose Police Department in its criminal investigation. 'Counsel for the plaintiff has previously asked San Jose Police Department to preserve any physical evidence collected and held in the investigation of the matter, and the parties will likely arrange for forensic testing of certain items seized by the San Jose Police Department,' a previous joint court filing states. Another woman claims she suffered injuries during a sexual encounter with Hayne in the Hunter Valley region in Australia and that she had photographs to back up her story. Police allege the assault of the 26-year-old woman took place in a home on September 30, 2018. The charges carries a maximum 20-year jail sentence if Hayne is convicted.
