This is the shocking moment a drunk driver sent his passengers flying into the air as he smashed into another car during a police chase. Damian Cleaver, from Leicester, crashed his open top Vauxhall Astra, carrying four passengers, while turning a corner in Birstall, Leicester. The 31-year-old crashed into an oncoming Mercedes and left the driver, who had just dropped his children off at school, suffering from whiplash. Damian Cleaver, from Leicester, crashed his open top Vauxhall Astra, carrying four passengers, while turning a corner in Birstall, Leicester. The car is pictured as it approaches the corner Cleaver, who was already banned from driving and has a 'horrendous' record for motoring crimes was jailed at Leicester Crown Court for dangerous driving. Alexander Wolfson, prosecuting, said there were four passengers in the defendant's convertible and some suffered minor injuries. Mr Wolfson said: 'The defendant was flying down the road and went head on into a Mercedes. The other driver had no chance of avoiding him. 'The defendant's car first caught the attention of the police because it was being driven too fast on Loughborough Road and that's why officers decided to follow.' The Mercedes driver was 'shocked and disturbed' although said he felt lucky to have survived. As the BMW rounds the corner it collides head on with the Mercedes. Alexander Wolfson, prosecuting said the Mercedes had no chance of avoiding him Cleaver, who already has a previous drink driving offence, was arrested at the scene and failed a roadside breath test. He was not tested at a police station until five hours after the crash, when he was still over limit. Cleaver's reading was just over 40 microgrammes of alcohol in 100 millilitres of breath. The legal limit is 35 microgrammes. The court was also shown selfie video footage from one of Cleaver's passengers, who filmed himself as they were chased by the police until the point of the collision, when the screen went blank. It showed just the face of the passenger, who was injured in the collision, while pop music was blaring out with police sirens in the background. As BMW collides with the Mercedes, Cleaver's passengers are sent flying into the air Judge Ebraham Mooncey said: 'When one watches the CCTV it's very frightening indeed. I'm quite satisfied you were showing off, driving that open top car, at speed during daytime. 'It was a residential area and you had no regard for other road users. You turned the corner and crashed into a car and there could have been very serious injuries and death, all sorts of things could have happened. 'Fortunately nobody was injured more than they were. You were being pursued by the police with the siren on. You had caught their attention because you were speeding down Loughborough Road in the first place.' Noting his history of motoring offences, Judge Mooncey said: 'Your history of offending is horrendous. You had no right to buy that car in the first place.' Nathan Palmer, mitigating, said: 'It was his car. He was the registered keeper notwithstanding he's disqualified from driving and has previous convictions. 'He's quite realistic about the options and he'll no doubt receive a substantial custodial term, but I urge you to keep it as short as possible. 'The distance involved was relatively short.' Cleaver, from Leicester, admitted dangerous driving, failing to stop, having no insurance, driving when disqualified and when over the legal alcohol limit. He also admitted breaching a six month suspended sentence for an earlier dangerous driving offence, of which four months was activated. The total jail sentence was two years. He was banned from driving for four years. All rights reserved for this news site dailymail and under his responsibility
