A convicted sex offender who avoided being deported back to Britain has been seen for the first time since being released from prison. 

British citizen David Degning, 57, was spotted at Batemans Bay on the south coast of New South Wales on Friday.

He was released from Sydney's Villawood Detention Centre this week where he spent the last 16 months. 

Degning was seen wearing a blue t-shirt, jeans and thongs while shopping for shoes.

Degning won an appeal in the Federal Court against Home Affairs Minister Peter Dutton, who attempted to have him deported.

He said he didn't believe Mr Dutton owed him an apology, but that he would be voting for Labor at the upcoming federal election.
