Unarmed Navy veteran Babbitt, 35, was shot and killed when she tried to breach a door leading to the House chamber when protesters stormed the Capitol.
The identity of the officer who shot and killed Babbitt has been shielded from the public despite multiple demands and the threat of a lawsuit from her family.
Her family have filed a $10million lawsuit against the officer and the Capitol Police and a separate case demanding the name is released.
The Department of Justice announced in April they would not bring charges against the officer responsible because there was 'insufficient evidence' they 'violated civil rights'.
An investigation also claimed the shooting was 'necessary' in and the officer acted in 'self-defense or in defense of the Members of Congress and others evacuating the House Chamber'.
