The Kentucky high school principal who was photographed getting lap dances from students during a 2019 homecoming event was named in a lawsuit filed by a student who alleged she was sexually assaulted by a classmate during a trip he chaperoned. 

Donald 'Happy' Mobelini and two Hazard High School teachers were named in a lawsuit filed in Perry Circuit Court. The trial is scheduled to begin in August of next year, according to Lexington Herald-Leader.

The unidentified former student, who was in her junior year at Hazard at the time of the alleged incident, claims in the lawsuit that the physical and sexual assault took place during a school trip to New York City and Washington, DC, in 2017.

Mobelini and the two teachers are accused in the lawsuit of failing to properly check up on students at various points during the trip. 

The student who filed the legal action alleges that students were drinking during the course of the trip.

At one point, students were left on their own to wander around Times Square in Manhattan, where they are said to have purchased alcohol. 

When the student complained that she was assaulted by a male classmate, Mobelini and the two teachers failed to adequately follow up her allegations, according to the lawsuit.

The student claims that sometime between 4am and 5am on October 29, 2017, a male classmate walked her to her room. Moments later, the boy physically and sexually assaulted her, according to the lawsuit. 

Mobelini and the two teachers have sought to have the case dismissed.
