The family of Robert Durst’s first wife Kathie is demanding to know why it took prosecutors nearly four decades to indict the eccentric millionaire for Kathie’s 1982 disappearance and presumed murder.

James McCormack, her older brother, called prosecutors out publicly Tuesday for failing to pursue justice in the case until November 1, when Durst was indicted for second-degree murder in New York.

McCormack thanked current Westchester County District Attorney Mimi Rocah for pursuing the charge, he slammed predecessors for letting the case slide.

‘To be clear, our family and our attorneys have provided DA Rocah - and several of her predecessors - with witnesses and evidence that prove Robert Durst murdered Kathie,’ McCormack told reporters gathered outside

'Yet it took the Office of the Westchester County District Attorney nearly 40 years to indict,' McCormack continued.

‘Now more than ever, it is important to ask why it took so long to get to this point. My family and I have serious questions and we deserve answers.’

Durst’s indictment for Kathie’s death only came after he was sentenced in California last month to life in prison for the 2000 murder of his best friend Susan Berman.

He shot Berman dead in a gangland-style execution so that she couldn't reveal what she knew about Kathie’s disappearance.

Prosecutors said Berman knew too much about what happened to Kathie and so she was silenced.

Berman is thought to have helped Durst cover his tracks after his wife's disappearance, posing as Kathie to phone her medical school to say she was sick on the morning after she was last seen alive.
