Michael Palacios, a 31-year-old bike messenger, lunged wildly at the crowds inside a Lower East Side branch of the fast food chain at 2:30am on Friday. He admitted he had been drinking, and said he was angry that people inside the restaurant laughed at him when a woman spurned his advances. On Monday Kathy Hochul, the governor of New York, questioned why Alvin Bragg did not order he be held pending trial. Palacios was released on Friday afternoon, having been arraigned on charges of criminal mischief and criminal possession of a weapon. Neither of the charges against him was eligible for bail under the state's controversial bail reform laws. Michael Palacios appeared extremely angry as he threw his ax down hard onto the furniture at a McDonald's in Manhattan in the early hours of Friday Hochul said there were 'many players in a criminal justice system, starting with the arresting officers who determine which charge to bring, as well as the district attorney, who will decide whether or not to stay with that course or have an up-charge from what is recommended. 'We're actually asking what the thought process was and the decisions that were just made because we have a question about it. 'Because they have the discretion to charge in a different way that would make them bail-eligible.' Palacios flew into a rage when a woman inside the Delancy Street restaurant rejected his advances - and others inside laughed at him. On Monday, he told ABC News that he never intended to hurt anyone, and just wanted to teach them a lesson about mocking him. 'My intentions were not to hurt anyone,' he said. 'My intentions were not to put anyone in the hospital or dice anybody up. 'The reason why I pulled out the hatchet was, 'Ok, I'm gonna get back at these guys.' 'I'm gonna make sure that they don't jump me again.' He insisted he was a 'normal guy' and was not mentally ill. He said he kept an ax in his backpack because, as a bike messenger, he sometimes needed to chop down trees blocking his way.
