The details are in documents recently turned over the congressional January investigation. 'We want to frame things so that Thomas could be the one to issue some sort of stay or other circuit justice opinion saying Georgia is in legitimate doubt,' Trump attorney Kenneth Chesebro wrote in a Dec. 31, 2020, email obtained by Politico. Chesebro argued that Thomas would be 'our only chance to get a favorable judicial opinion by Jan. 6, which might hold up the Georgia count in Congress.' Another attorney, John Eastman, replied: 'I think I agree with this,' adding that it would 'kick the Georgia legislature into gear' to help overturn the results. Newly published emails show how Donald Trump's legal team targeted Justice Clarence Thomas as they tried to overturn Joe Biden's 2020 election win Thomas is the justice assigned to handle emergency matters, responsible for issuing temporary blocks so the court can consider the case more fully later. His role has already come under scrutiny after it emerged his activist wife Ginni had lobbied Arizona lawmakers to reverse Biden's win there. She was also in touch with White House Chief of Staff Mark Meadows urging him to keep working to keep the president in power. The communications were reportedly last week handed over the House select committee investigating that attack on the U.S. Capitol building. They were among eight emails that Eastman had tried to keep from the investigation until a judge ruled that they could constitute evidence of crimes. Other messages underlined their view of Thomas as their best chance. '[I]f we can just get this case pending before the Supreme Court by Jan. 5, ideally with something positive written by a judge or justice, hopefully Thomas, I think it’s our best shot at holding up the count of a state in Congress,' Chesebro wrote in another Dec 31 email. Ginni Thomas, the wife of conservative Supreme Court Justice Clarence Thomas, is an outspoken supporter of Donald Trump's claim that he was the rightful 2020 winner Trump loyalists who falsely believed the election was stolen from him are pictured gathered in front of the U.S. Capitol Building on January 6 In other words, they were not expecting a legal win at the Supreme Court but simply wanted a delay that would sow doubt and embolden states, Congress or Vice President Mike Pence to undermine the results. The emails also reveal deep concerns within the team about possible legal jeopardy if Trump signed documents related to a lawsuit challenging the results in Georgia, and claiming fraud. 'I have no doubt that an aggressive district attorney or US attorney someplace will go after both the President and his lawyers once all the dust settles on this,' Eastman wrote in an email to two other private attorneys.
