Danny Masterson believes he is 'entitled to sex any time he feels like it - and if you say no, he doesn't care,' prosecutors told the jury at his rape trial Tuesday.

Standing in front of a screen displaying headshots of the actor's three alleged victims, Deputy District Attorney Reinhold Mueller began his closing statement, telling the court that the women 'were forcibly raped by' the famous Scientologist. 

He described the TV star as 'a man who was controlling and a man for whom no never meant no.'

Turning to look at Masterson who sat looking dapper in a light brown suit and tie, Mueller told jurors that 'he has been sitting here for four weeks, looking like a well-groomed, well dressed gentleman.

'The victims here know him to be quite different,' he continued. 

'He was at the center of this tight group of friends. He was the guy who would have the parties at his house.

'If you got a little intoxicated, he would invite you to spend the night, just to be safe.

But, Mueller added, 'if you were a young woman at his home, you were far from safe.'

'If you were incapacitated in his bed he would rape you,' he continued.

'If you were not yet intoxicated, he would offer you the alcohol to get there and rape you.

'He believes he is entitled to sex with you any time he feels like it and if you say no, he doesn't care.'

Mueller urged the jury to show Masterson 'that no actually means no.'

The 46-year-old actor who has been free on $3.3million bail since his arrest in June 2020 - has pleaded not guilty to raping three women at his Hollywood Hills home between 2001 and 2003. He is facing a sentence of 45 years to life in prison if he's convicted.

His accusers - whom DailyMail.com is identifying only as Jane Does 1 through 3 - are all ex-Scientologists and are also suing him and the Church of Scientology in civil court, claiming that they've been harassed and intimidated since reporting him to police.

Masterson was seen arriving in court with coffee in hand earlier on Tuesday, flanked by wife Bijou Phillips. 

He wore a brown suit with a striped tie, and brown sunglasses. 

As trial proceedings entered their fifth week on Monday, actor Billy Baldwin turned up at court to support his brother-in-law.

Baldwin is married to singer Chynna Phillips, whose younger half-sister Bijou Phillips is Masterson's wife.

Baldwin – the third of the four Baldwin brothers – could be seen in jeans, a blue shirt and brown jacket walking with Masterson, who has pleaded not guilty to three counts of rape.

On Monday Masterson revealed he would not testify in his own defense at his rape trial. 

Judge Charlaine Olmedo – who is presiding over the trial – told the actor that he did not have to take the witness stand.

'You have the right to remain silent – that is your right, protected by the constitution,' the judge told Masterson at the start of the the fifth week of the trial at the city's downtown criminal court.

She asked him, 'Have you had a chance to talk to Mr. Cohen (his lead attorney, Philip Cohen) about whether or not you want to testify?'

'I have, your honor,' Masterson replied. 

'What is that decision?' asked Judge Olmedo.

'To not testify,' he answered.

Prosecutors wound up their case against Masterson last Thursday. Monday it was the turn of his legal team, Cohen and co-counsel Karen Goldstein, to present their defense to the jury.

But when Judge Olmedo asked Cohen if he was calling any witnesses Monday, he said he was not.

Masterson, 46, who starred in the TV sitcom That '70s show, is accused of raping three women at his Hollywood Hills home between 2001 and 2003.

He's pleaded not guilty to all the charges and he's facing a sentence of 45 years to life in prison if he's convicted.

Masterson, a Scientologist  has been free on $3.3 million bail since his arrest in June 2020. He showed up at court Monday in a dark blue suit, gray shirt and light blue tie.

 Before the jury was seated Monday, Cohen submitted a motion to dismiss all the charges, telling Judge Olmedo that if 'bias, sympathy, emotion and regard from public opinion' were removed from the case, 'there is not a reasonable jury' that would find Masterson guilty beyond a reasonable doubt.

Deputy District Attorney Reinhold Mueller countered, telling the court that the evidence presented against Masterson 'supports the fact that there was forcible rape in all three counts.'

Judge Olmedo denied Cohen's motion to dismiss, saying that she found the DA had presented 'sufficient evidence' to send the case to the jury.

The judge also ordered one of the alternate jurors to replace a jury-member who tested positive for Covid on Sunday and cannot continue.

After giving the jurors lengthy instructions, Judge Olmedo dismissed them and ordered them back Tuesday morning when DDA Mueller will start his closing arguments.

Then it will be time for the closing arguments of defense attorney Cohen.

In court Monday, supporting Masterson were his wife, actress Bijou Phillips, 42, her half-sister, actress Chynna Phillips, 54 and Chynna's husband, actor Billy Baldwin, 59.
