Sydney swim coach Kyle James Henk Daniels will never now face a third trial on sex assault charges after allegations he abused young female students were abandoned.
But the former coach will return to court in March to demand prosecutors pay the cost of his defence.
Mr Daniels' lawyer Urania Zafiris said her client had consistently denied all the accusations and the decision to scrap another trial was 'entirely appropriate'.
'Mr Daniels has always maintained his innocence of all charges in respect of these matters,' lawyer Urania Zafiris said in a statement on Friday.
'The jury verdicts and decision to discontinue are an entirely appropriate outcome consistent with that innocence.'
