NBC4 New York is reporting that Penny, 24, could face charges over 30 year-old Neely's May 1 death as early as Friday. Penny is expected to surrender himself to a police station. It had been reported that Manhattan DA Alvin Bragg had been considering putting the case to a grand jury. But he is now believed to be going straight to charges, without first putting the case before such a jury. Neely died on an F train at Broadway Lafayette Station around 2:25pm on the afternoon of May 1. Images showed Penny with his arm around Neely's neck. Some eyewitnesses claim he maintained the chokehold for around 15 minutes. Penny, of Glendale in Queens, has retained an attorney who issued a statement claiming his actions were taken in self-defense, and that he did not intend to harm Neely. Neely was a schizophrenic with 44 previous arrests. His family say his mental health declined after the brutal 2007 murder of his mother at the hands of her abusive partner.
