On Thursday, the Senate passed a resolution 59-41 terminating Trump’s executive action. Twelve Republican senators sided with Democrats to pass the measure saying the the president’s decision to allocate funds that have not been earmarked by Congress was outside his powers. Trump has the authority under Article 1, Section 7 of the US constitution to reject a proposal from Congress. However, Congress has the ability to override a veto if it can obtain a two-thirds majority.

But this looks highly unlikely after Thursday’s vote.

The fate of the president’s emergency declaration will be decided by the courts where various legal battles are currently ongoing.

House Speaker Nancy Pelosi responded in a statement saying the chamber will vote on March 26 to respond to Trump’s veto.

She said: "The President has chosen to continue to defy the Constitution, the Congress and the will of the American people.
