MPs passed legislation to prevent a no deal Brexit in a House of Commons vote last month, which saw Theresa May under pressure to extend Britain’s stay in the EU rather than crashing out. But a report by experts warned the law, spearheaded by Labour’s Yvette Cooper, would not stop her successor if they were set on a no deal Brexit. Maddy Thimont Jack, a senior researcher at the Institute for Government, a Whitehall think tank, said: “It would not be a straightforward process.
“A motion opposing a no-deal Brexit would obviously have political power but it would not be legally binding.
“If push comes to shove and you had a prime minister who was prepared to go for no-deal and take the consequences then it is not obvious to see a clear route by which parliament could prevent it.”
The Institute said a new prime minister would be under no obligation to rule out no deal Brexit.
