Joe Giudice's misery continues.

The 46-year-old reality star 'was crying, tearing up [and] had his head in his hands' upon learning the U.S. Immigration and Customs Enforcement had denied his appeal on April 11, a source told Radar.

The source, a mother of another inmate at the Clinton County Correctional Facility, where Joe remains in ICE custody, said that her son said that Giudice has been 'miserable' amid the recent news.

'He apparently broke down last week at the lunch table,' the source said. 'He was just staring ahead, not touching his food. 'He was crying, tearing up, had his head in his hands.'

Joe, who has four children with Teresa - Gia, 18, Gabriella, 14, Milania, 13, and Audriana, nine - was born in Saronno, Italy and brought to the United States as a one-year-old.

He has never applied to be a U.S. citizen. Federal law states Joe - who pleaded guilty to mail, wire and bankruptcy fraud charges in 2014 - can be deported due to 'a crime of moral turpitude' or 'aggravated felony' as result of his citizenship status.

Joe in March was released into ICE custody after his prison sentence at Fort Dix, New Jersey's Federal Correctional Institution in his 2014 fraud conviction.

A lawyer for the family, James J. Leonard Jr., said in a statement to DailyMail.com that efforts are ongoing to keep Joe in the country.

'We are extremely disappointed that the Board Of Immigration Appeals has denied Mr. Giudice's appeal,' Leonard said of the recent ruling. 'We have filed a stay with the Third Circuit Court Of Appeals and will continue to fight to keep Mr. Giudice in the United States,
