Waitress sacked from pub awarded $2,500 in compensation

A waitress who claimed she was told she would have 'more time to be a mum' when she was sacked has been awarded $2,500 in compensation.

Corina Shears was off sick with 'gastro and tonsillitis' in September when she received a text from the Angle Vale Tavern, north of Adelaide.

'Hey Corina, hope you are feeling better. Can I please get your doctor's clearance and we have your shifts covered for next week,' her assistant manager wrote.

When she asked why she was replaced on the roster when she planned to be back next week, she got a call from manager Josh Callery.

The young mother told the Fair Work Commission he said she was being let go because she or her child were 'always sick'.

Ms Shears replied that she always provided a doctor's certificate when she was sick and unable to work.

'He said we are a small team and I am being a liability. He then said to me... I now will have more time to be a mum,' she said.

'I made him aware this was unfair dismissal and I was on sick leave and had supplied doctor's notes. Josh never once stated that my job was still active and to supply him with a doctor's clearance to return.' 

Angle Vale Tavern, a bistro attached to a local soccer club, disputed her version of events, claiming she was not sacked but given time to work out her health.

Mr Callery said he called her to 'discuss what has been happening with her health' as how much time she was taking off was affecting the team.

He said she asked for her hours to be cut to two days a week 'due to trying to work out [her] relationship situation'.
