Lindsay Lohan's father Michael says that his estranged wife's claims that he attacked her are all a lie and insists he never touched her.
'I did not touch her, I wasn't near her, this is just a lie,' Michael Lohan told DailyMail.com just after he was released from custody Tuesday in Southampton, New York.
Lohan, 59, was arrested Monday after Kate Major claimed that he had choked her at her Long Island home when she confronted him about his internet browsing history.
But according to Lohan, Major only filed the police report against him because he called the cops on her Sunday, leading to her arrest for DWI.
He says he was driving Sunday in Southampton and passed Major on the road, they saw each other and then he pulled into a gas station next to her.
'I pulled in next to her and she was absolutely whacked out of her mind drunk,' he said. 'Sitting next to her was a bottle of vodka.
'I said that's it. So I got on the phone and called the police. The police tracked her down and arrested her on Sunday.'
He claims Major had a blood alcohol content of .24, more than twice the legal limit.

Lohan says Major was released from custody at 1am and agreed to go to rehab and was meeting with lawyers on Monday to fight the charges.
He says he was then blindsided that afternoon when cops came to arrest him as he was out shopping with his two young sons that he shares with Major.

'I wasn't even with her. This is all in retaliation to me getting her arrested for DWI. That's all it is,' he claims.
Lohan says cops told him during his arrest: 'Mr. Lohan, all it takes is an accusation and she had a bruise on her neck.'
The deputy who wrote up Major's police report said there were visible bruises on the right side of Major's neck and her voice was hoarse.
But Lohan claims: 'She grabbed her own neck! I didn't touch her!'
He is charged with criminal obstruction of breathing or blood circulation and second-degree harassment and was released Tuesday but must wear a monitoring device.
Lohan was in handcuffs as he was escorted into court by two officers Tuesday.
Sources tell DailyMail.com that while in custody, Michael claimed to have a heart attack and was taken to the hospital for an evaluation following the arrest.
Kate has an order of protection against Michael but both are allowed in their home.
Sources tell DailyMail.com that the judge allowed it because Michael has primary custody of their two sons Landon, 7, and Logan, 5, out of Florida court.
